Terms & Conditions
1. Scope
These General Terms and Conditions apply to contracts for the rental of rooms for accommodation as well as all further services and deliveries provided by Boutique Hotel Amalienburg (Amalienburg GmbH, Amalienburgstr. 24-26a, 81247 Munich, Germany) in connection therewith.
2. Conclusion of contract
The contract is concluded upon acceptance of the customer's request by the hotel. The hotel is free to confirm the room reservation in writing, by email or via the online booking system.
3. Services, prices, payment
The hotel is obliged to hold the rooms booked by the customer available and to provide the agreed services. The customer is obliged to pay the agreed or the hotel's applicable prices for the provision of the room and any other services used. Prices include statutory VAT.
4. Cancellation by the customer
Cancellations made up to three days before the agreed arrival date are free of charge. During trade-fair periods and peak season, the free cancellation period is 14 days before arrival. If cancellation occurs after the applicable deadline, or if the customer does not arrive, the hotel is entitled to claim reasonable compensation unless it is able to re-let the rooms in question. Specific cancellation conditions are communicated to the customer at the time of booking or stated in the respective booking confirmation.
5. Withdrawal by the hotel
Where the hotel has granted the customer a free right of cancellation, the hotel is likewise entitled to withdraw within that period. The hotel is further entitled to withdraw from the contract for objectively justified reasons, in particular in cases of force majeure or other circumstances beyond the hotel's control.
6. Arrival and departure
Rooms are available to the customer from 3:00 p.m. on the agreed day of arrival. On the agreed day of departure, rooms must be vacated and made available to the hotel by 11:00 a.m. at the latest. In the event of later vacation, the hotel may charge a proportionate amount for the additional night due to the delayed release of the room. Deviating times can be agreed individually.
7. Payment
Hotel invoices without a due date are payable in full within ten days of receipt. The hotel is entitled to require a reasonable advance payment or security (e.g. a credit card guarantee) upon conclusion of the contract.
8. Pets
Pets may only be brought with the hotel's prior written agreement. A fee per animal and night applies. Animals are not permitted in the restaurant or bar areas.
9. No-smoking policy
Smoking is prohibited throughout the hotel, including all rooms and apartments. A cleaning fee of at least €100 will be charged for violations of the no-smoking policy.
10. Guest Wi-Fi
The hotel provides guests with free Wi-Fi. There is no entitlement to constant availability or a specific transmission speed. Use is at the guest's own responsibility within the bounds of applicable law.
11. Liability of the hotel
The hotel is liable with the diligence of a prudent businessperson for its obligations under the contract. The hotel is liable for items brought in within the statutory framework. Claims by the customer against the hotel generally become time-barred one year from the statutory start of the limitation period, unless a shorter or different period is prescribed by law. Further limitations or exclusions of liability are governed by statutory provisions.
12. Final provisions
German law applies. For commercial transactions, the place of performance and payment as well as the exclusive place of jurisdiction — including for disputes relating to cheques and bills of exchange — is Munich. Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
